We are authorised and regulated by the Financial Conduct Authority (FCA 718065). We are an independent business finance credit broker working with a select number of third party credit providers to whom we introduce business finance proposals. We do not lend our own funds. We do not provide personal loan or consumer finance.

For the purpose of the Data Protection Act 1998 (the Act), Regulation (EU) 2016/679 (General Data Protection Regulation) and Privacy and Electronic Communications Regulations (PECR), the data controller is FUNDINGROUND Ltd. of Office 11, Navigation Business Centre, Millgate, Newark, NG24 4TS. Our nominated representative for the purpose of the Act is Lucy Painter.

By supplying data to us you will provide information about yourself and others which the Data Protection Act defines as personal data or sensitive personal data.  Data, including your telephone number, will be used by FUNDINGROUND Ltd. and other carefully selected companies for administration, credit checking, marketing and research purposes and will be added to certain databases which may be checked by various organisations including the police.

By supplying data, you give explicit consent for all the data provided to be used in this way unless you tell us otherwise. If you would like us to remove personal information from our records please write to the Compliance Officer at FUNDINGROUND Ltd., Office 11, Navigation Business Centre, Millgate, Newark, NG24 4TS so that we may consider your request.

Complaints

Our aim is to provide you, at all times, with a first class standard of service. However, there may be occasions when you feel this objective has not been met.

Should you wish to use an alternative means of communication, we are happy, on request, to correspond with you by e-mail.

Please include details of your name and address, a contact telephone number, your agreement or quote number and details of why you are unhappy. This will help us to respond to you as quickly as possible. If we don’t have enough information to investigate your complaint, we will contact you to ask you for further details. In all cases we will send a written acknowledgement of your complaint to you within 5 working days of its receipt. In our acknowledgement, we will advise you of the name and job title of the person who will be dealing with your complaint.

We will ensure you are regularly informed of our progress with regards to the investigation of your complaint. By the end of eight weeks after receipt of your original complaint letter, we will send you:

  • A final response; or
  • A letter explaining why we are still not in a position to issue a final response and advising you of when we expect to be able to do so.

Temporary changes to handling motor finance complaints (effective 11/01/2024):

  • The temporary changes apply to complaints about motor finance agreements involving a discretionary commission arrangement where the regulated credit agreement was taken out before 28 January 2021.
  • The 8-week complaints response deadline for such complaints is being paused whilst a review is undertaken.  Firms will not have to respond to a complaint about a discretionary commission arrangement until after 25 September 2024 at the earliest.

For the purposes of handling complaints our working day is 9am to 5pm Monday to Friday, not including Bank Holidays.

Who is the Data Controller

We will process your data for the purposes of administering financial arrangements or employment, depending on your enquiry. FUNDINGROUND is also required by the Financial Conduct Authority to ensure that its clients and employees are of good character, and it is our policy to complete credit references where appropriate.

If your application is unsuccessful, we will keep your information for a reasonable period of time in line with legal requirements and for administration purposes. We may also contact you if other options or opportunities arise in the future which we think may be suitable for you.

Your Rights

We comply with and are registered under the data protection laws in the United Kingdom and take all reasonable steps to prevent any unauthorised access to your personal data.

You are entitled to see details of the information we hold about you. If any of the information held is inaccurate we will also make any necessary amendments and confirm to you that these have been made.

You have the right to request at any time that we and/or carefully selected companies cease processing your personal data for marketing purposes. You are also entitled to ask us to remove personal information from our records and if you wish to do this then please write to the Compliance Officer at the address above. Please provide your full name, address and date of birth when contacting us.

We reserve the right to amend or modify this privacy and cookie policy at any time in response to changes in applicable data protection and privacy legislation. We also reserve the right to transfer our rights under this Agreement at any time.

How will we use your data?

The information we receive from you is used to provide quotations and arrange finance with a funder. You have the right to cancel your authority to use such information. Before or after you enter into any agreement with a funder, to help make credit decisions, the funder will make a credit search with a credit reference agency. If you are a company or partnership they will also make enquiries about the principle director(s) or partner(s) with a credit reference agency. Full details of the use and disclosure of your information by the funder is contained within the terms and conditions of any agreement which you should read before signing.

We will keep in contact with you over the term of any financial arrangement agreed and beyond, and occasionally send you information of products and services we consider to be relevant to your business. You have the option to opt out of theses communications at any time.

If you provide us with your data for employment enquiries, your data will only be used for the purposes of dealing with your employment enquiry. We will not use your information for any marketing purposes.

Use of Cookies

A cookie identifies your computer to a server that then enables information to be stored on the hard drive of your computer. Cookies allow a computer to be identified as corresponding to one that has accessed another website or visited a website previously.
